Terms of Service
These Terms govern access to Vallum’s website, hosted services, and related support unless a signed agreement says otherwise.
Using Vallum
You may use Vallum only in compliance with applicable law, these Terms, and any written order or service agreement between you and Vallum Security, Inc. You are responsible for your accounts, authorized users, domains, routing configuration, and the activity conducted through your organization.
Acceptable use
Do not use the service to violate another person’s rights, gain unauthorized access, distribute malware, evade security controls, disrupt networks, or test systems without permission. You may not interfere with the service, probe non-public systems, or resell access unless Vallum agrees in writing.
Customer systems and data
You retain ownership of your applications, configuration, and data. You grant Vallum the limited rights needed to host, transmit, secure, and process that material to provide and support the service. You are responsible for having the rights and notices required to submit data to Vallum.
Software and intellectual property
Vallum and its licensors retain all rights in the hosted service, website, documentation, branding, and non-open-source software. Components published under an open-source license remain governed by that license. Feedback may be used without restriction or obligation.
Service changes and availability
We may improve, modify, suspend, or discontinue features. Uptime and support commitments for paid production organizations are set out in the Service Level Agreement, which forms part of these Terms; a signed agreement controls where the two conflict. Service credits under that agreement are the sole and exclusive remedy for missed availability. Beta or evaluation features, trials, and free evaluations carry no availability commitment and may change at any time.
Confidentiality
Each party will protect the other party’s non-public business, technical, and security information using reasonable care and will use it only for the relationship. This does not cover information that is public through no fault of the recipient, already known without restriction, independently developed, or lawfully received from another source.
Suspension and termination
You may stop using the service at any time. We may suspend or terminate access for a material breach, security risk, nonpayment under an applicable order, or unlawful use. Provisions that by their nature should survive—including ownership, confidentiality, disclaimers, and liability limits—remain in effect.
Disclaimers
Except for commitments in a signed agreement, the service is provided “as is” and “as available.” To the extent permitted by law, Vallum disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Vallum is one layer of a security program and does not guarantee that every attack will be detected or prevented.
Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data. Vallum’s aggregate liability relating to the service will not exceed the amount paid for the service during the twelve months before the event giving rise to the claim. These limits do not apply where the law prohibits them.
General terms
These Terms, together with any applicable order or signed agreement, are the entire agreement for the service and supersede prior discussions on that subject. If a provision is unenforceable, the remaining provisions continue in effect. Neither party may assign the agreement without consent, except in connection with a merger, acquisition, or sale of substantially all relevant assets.
